Mr. Kern requested the items Deft. was to forfeit be made a condition of the sentence. Further, Mr. Kern stated no recommendation. DEFT. MICON ADJUDGED GUILTY of OPERATING AN UNLICENSED INTERACTIVE GAMING SYSTEM (F).COURT ORDERED, in addition to the $25.00 Administrative Assessment fee, a $150.00 DNA Analysis fee including testing to determine genetic markers, $25,000.00 Fine, and $3.00 DNA Collection fee, Deft. He has to maintain full time employment or if part time work community service so that is obviously why he has this stooge job of being the being a Loss Prevention manager for the Drones place.
Micon was lucky. His expensive representation saved him from the boys in the pen. Those big black guys like them some new/fresh skinny dudes to break in properly so Micon would have been their type.
Yeah, he's not going to like that. But still he's got to be ready to suck Schonfeld's Jew dick for keeping him out of prison and minimizing that fine down to a fraction of what he made running Seals.
The drug testing thing would be a KILLER for him if Nevada didn't have medical marijuana. However, all he has to do is get a medical marijuana card (if he doesn't have one already), and he will be exempt.
Interesting how he can't own any firearms, despite his crime being nonviolent. He does have at least one gun, and I assume he will have to give that up, unless he's an idiot and wants to keep it around and risk his probation (which I doubt he will).
He isn't allowed to associate with felons. This might be something concerning to him, since many poker players and bitcoin enthusiasts have shady pasts.
The employment thing is exactly what we thought -- that he got Crazy Mike to give him a "cover job" so he could claim employment and still "not work for the man", which has always been very important to him.
It says something about an "imposed curfew", but does not state what that curfew would be. But it's possible that all-night gambling benders will no longer be possible, which may actually help him. Brandon used to tell stories about going out with Micon all night and gambling with him.
He can't leave Nevada without permission. This probably won't be a big deal to him, as he rarely traveled outside of Vegas in the years he lived there. I remember expressing to him how surprised I was that he didn't visit California very often, given all of the things to see there, and its proximity to Vegas.
He has to submit to warrantless searches at the government's discretion. He has to hate that, too, but it's possible they won't do this without reason. Still, he's going to have to constantly be concerned about what's on his computer and what he keeps in his house. I do know someone (a woman in her 50s, not a poker player) who had a DUI conviction and had her apartment recently spot-searched for alcohol! So this does happen.
Notice that the probation says nothing about gambling, aside from not running an online gaming site. Many here theorized that he would be restricted from casinos, but I never believed that. Once we saw him at WSOP events this year, I knew that this couldn't have been a term, because he wouldn't have before-the-fact violated it.
The probation also does NOT say anything about social media and criticizing the government. I thought that it might, such as restricting "inflammatory speech about the government or law enforcement" during those 2 years. But nothing about that at all.
i wonder if the medical marijuana issue is going to get hamstrung by this being a felony case; pot isnt federally legal anywhere.
