    You related a story a few pages back about a black guy stealing a white girls phone @ a demonstration & when the validity of the story is questioned by some posters you present some anonymous police blog as proof & close with something about sucking your nuts which is the equivalent of "na na na na na , see I'm right" .

    What you fail to comprehend is that nobody doubts that you actually really did hear/read that "story" somewhere, we just seriously doubted that that incident ever really happened & I believe it was subsequently shown later in this thread that the incident really didn't happen. I don't remember you offering to gargle anybody's nutsack in return for being wrong, nor were you ever asked to.

    You then went on to tell everyone that the law is the law & we can't just pick & choose which laws we obey & I posted something in the last post on page 7 that you just conveniently glossed over & never responded to & is what most here are upset about. FTR, I'm more appalled by the aftermath & just, seemingly, letting the guy die. It looked like they thought he was faking unconsciousness & told the EMT that she was potentially in danger. I'm not saying that's exactly what happened, & this is where I'd like to see an unedited version, but WTF were they doing?

    Then you tell us all that we're letting emotion cloud our judgement when nothing could be further from the truth. We're looking at this logically while you're going into other threads like the Rio shooting one & making emotional comments like " at least they didn't choke him". You act like we're all advocating passivity when there is real danger to society like a guy running around with a fucking gun threatening people. I think I can safely speak for everyone speaking out against what these police did in the Eric Garner incident, myself, Crowe, varys, etc, & say absolutely shoot the fucking guy with the gun threatening people & shoot to kill.

    Eric Garner was not a "danger" to anybody at that moment. They have to at least try to talk the situation down & from what I've seen on that recording, they did nothing like this. Of course, they may have talked for 20 minutes before the recording but, I'm commenting strictly on what is shown.

    There must have been a dry-rub rib special @ Chili's that they had to get to or something, which is understandable, because those ribs are awesome.

    the blog is irrelevant. Lets stick to the case. You can look at it LOGICALLY (which I dont necessarily disagree with), but Im looking at it LEGALLY, which is the only thing that matters. Whatever you think, whatever you feel, DOESNT MATTER because....LAW.

    The only time Garner seemed to be a threat to anyone, was when HE FAILED TO OBEY THE LAW and would not let the officer apply the handcuffs. AT THAT POINT, the officers can do what they can (legally) to subdue him and place the handcuffs on him. If you dont like the choke, HAVE THE LAW CHANGED SO THEY CANT DO IT. But....until then....LAW.

    And you're right...neither of us know what happened during the time the recording was off, so we can all just speculate.


    If you will look at this situation from a LEGAL standpoint, there was nothing done wrong, as far as I can tell. The uproar is based on what individuals feel was the right thing to do/what could have been done, etc. But, it doesnt matter, because the laws were followed, and an individual failed to follow it, and a tragedy occurred.

    Seriously, what part of the FACT the officers applied a choke hold they were specifically told not to & a guy dies as a direct result don't you understand. The part of "a direct result" isn't my "opinion", it was the coroners finding in their report. He did not die of a heart attack as you've stated many times already.

    You've already said we can't just decide which laws we follow but the cops are doing exactly that where it comes to their own protocol & procedures. I guess you can claim "but that's just a protocol/procedure & not a law" but that's arguing semantics. If I just knowingly ignore my company's procedure & protocols & let somebody do something they're not supposed to & somebody dies as a direct result, which is what happened here, I'm fired, at the very least, but this guy wasn't even disciplined from what I've seen.

    What I mean by that is even though they were told NOT to do it, there is no LEGAL punishment for them doing it.

    Some of the brass could say "We reallllllly dont want you doing it....BUT, in extreme cases, where the dude is a giant motherfucker, and grabbing his arm just isnt going to cut the mustard, we overlook it if it helps you get the guy on the ground without getting yourselves injured".


    If there is a LAW that says, "You cannot choke a person", well, then that officer should lose his badge and possibly do time.

    Anything outside of LAW is just your opinions. Your opinion is that the cop killed a guy, the cop shouldnt have choked a guy, they should have left the guy along, he wasnt hurting anyone, cant they go after bigger criminals, etc. I may even agree with one or more of these statements.


    in the end....Laws were made, and this big guy broke them and sadly suffered. Cops broke no laws. END.

    What you're saying is the police are not above the LAW but they are above any procedures & protocols & do not have to follow direct orders of their bosses because there are absolutely no repercussions for their actions because they aren't breaking an actual law.

    Explain why I'd be fired in my workplace but nothing happens to these officers & specifically the guy who applied the choke hold? Better union I guess.

    thats a hard comparison. I dont know what you do for work, but I would imagine it has absolutely nothing to do with anything involving risking your life or subduing criminals, so I have to come up with something different that would pertain to your scenario. I dont know if I can, but this may be somewhat close.


    You are an EMT. You are out on call, and a man is having an epileptic seizure. He is flailing around, and is about 6'6, while you are maybe 5'8 150lbs. You come to his aid and are about to administer (this is damn near impossible to come up with a scenario because there arent many jobs that would require you to physically restrain someone for your job...maybe a bouncer) some medicine when you realize that the drug you need is not available. You know there is another drug that you have that you know will work, but your superiors have stated not to use it because its experimental. Its Legal for you to administer it, however, your bosses dont really want you to because there is a 1% chance that a heart attack can occur.

    You inject it into the patient, and he stops flailing around where he could have injured you and or others (see how the scenario where the guy died is REALLY SPECIFIC now...it doesnt apply to work place situations) and he seems to be getting better. All of a sudden, he has a heart attack and dies.

    You did whatever you could to prevent him from flailing around and hurting you. You knew the drug had a 99% chance of getting him to stop flailing around, even though your boss didnt want you to administer it, but you felt that it was the BEST WAY to get him to stop flailing around, and the drug WASNT ILLEGAL to administer.

    Did you "KILL HIM"? Semantics. He died while you were trying to give him something.
    Should you be arrested and charged with murder? You were DOING YOUR JOB. YOU DIDNT DO ANYTHING ILLEGAL...you just did something that you boss didnt want you to do.



    Workforce situations are different because your job is completely different from putting your life in danger by trying to do your job and arrest criminals...which is what he was. He was doing something illegal. Selling a piddly ass cigarette.

    Keep in mind. If the police boss tells you not to apply chokeholds, but its not illegal, the reason is that they would like you to use your best judgment when trying to apprehend someone WHO IS NOT OBEYING THE LAW AND RESISTING ARREST.

    Would that cop come up upon a 16 yr old boy that stole some candy (breaking the law) and apply a chokehold? The cop should be fired, do time, get raped in jail, etc for that. Its not illegal though...but you have to figure the cop isnt going to HAVE TO resort to that with a child.


    A massive dude weighing over 400 lbs, whose arms were bigger than the police officers legs, is going to potentially do some serious damage to a copy should he decide he doesnt want to have to put his hands behind his back. The cops tried to grab his arms. If he obeyed, and placed them behind his back, the cuffs would go on, and they would walk him to the car, open the door, make sure he didnt hit his head on the door, and then close the door and drive off.

    HE DIDNT OBEY.


    They now have to make a split second decision. The cop behind sees arms flailing, and jumped up a bit to get the guy in a choke, so he wouldnt strike the cop standing in front of him. The others rush in to make sure the guy goes down. They didnt bash him or slam him to the ground...you can see the guy's right hand brace his body weight, and the guy goes down. (Im fuzzy on this part though...). I dont remember how long he held the choke, but if it his hands were now behind his back, he should have started to ease up on the choke. He probably held it A BIT TOO LONG, IMO. But thats my opinion, and that doesnt matter here.

    At that point, the cops are now pretty much out of danger (until he stands up, where he could decide he wants to kick or slam into someone). His previous arrests now come into play. How many strikes does this guy have? Is he going to flip the fuck out because he knows he will now do some serious time?...those guys lose their shit at that point and realize FUCK IT, do some damage...Im screwed...

    Thats what happens sometimes when cops pull someone over who happens to have (and the cops dont know this) maybe 500K in coke in the trunk. Guy gets pulled over, guy gets out of car. Everything fine. "Mind if I check the trunk?" (guy now tries to look calm, but knows he is about to do 20 years)..."sure"...cop opens trunk, guy pulls out a gun and tries to shoot cop. Try to live every traffic stop like that, 24/7. You have no idea what is going on with people. They can snap in a milisecond, punch you out, take your gun, shoot you and flee. Its totally fucked up.

    And now, with all this HANDS UP, and I CANT BREATHE bullshit, do you think any cop wants to deal with this crap? You are going to have many cops saying Fuck This Noise and finding a new job. The shitty cops will stay though. They dont have anything else to do.


    What happened in Ferguson and NY is a tragic ending, to a situation that got out of hand, when the persons doing something illegal, refused to obey the law, and they sadly paid the worst price. If you are glorifying them and saying fuck the police, you arent educated on whats really happening, or your blinded or biased. LAW.

    Does the entire process need a makeover? Dont know. Not for me to say. Some tweaking for sure. Maybe make the punishment harsher for people who dont obey commands. Maybe write larger fines for people who dont obey commands. That would bring in more money to pay for more police. Punish the people who like to break the laws financially, instead of tossing them in jail and having tax payers feed them. Chicago cops write tickets for weed now, because its not worth bringing them in so they can hang out in a cell. Here's a $500 ticket. Thanks for playing.

    The officer that applied the choke hold lost his gun and badge. In other words even his own department didn't think he handled the situation correctly. He wasn't indicted because the prosecutor chose that there would be no trial as is often the case when the police break the LAW and that is one of the reasons people are pissed off in this case.

    To give a little perspective how fucked up the grand jury system is...

    ...U.S. attorneys prosecuted 162,000 federal cases in 2010. Grand juries declined to return an indictment in 11 of them. So if you're a civilian then the odds of you avoiding a trial are roughly 1 in 15000. On the other hand in Dallas, grand juries reviewed 81 shootings between 2008 and 2012 and returned just one indictment in cases that involved an officer and a civilian. So if you're an officer you end up avoiding a trial 80 times out of 81. There seems to be mild disparity here.
